1. Acceptance of Terms

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Modern Bond (“Company,” “we,” “us,” or “our”), governing your access to and use of joinmodernbond.com and all associated services, including our community platform, coaching services, digital products, and marketplace (collectively, “Services”).

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform. Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the updated Terms.

2. Eligibility and Age Requirement

YOU MUST BE AT LEAST 18 YEARS OF AGE TO ACCESS OR USE THE SERVICES.

By using the Services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding contract
• You are not barred from receiving services under the laws of your applicable jurisdiction
• You will provide accurate, current, and complete information during registration and maintain the accuracy of such information

We reserve the right to terminate accounts and refuse service to anyone we reasonably believe to be under 18. If we discover a user is under 18, we will immediately terminate their account and delete associated data.

2.2 Age Certification and Liability for Misrepresentation

Before accessing the Services, you are required to affirmatively check a box certifying, under penalty of breach of this Agreement, that:

• You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater)
• This self-certification is truthful, accurate, and made knowingly
• You are not accessing the Services on behalf of, or for the benefit of, any person under the age of 18
• You understand that the Services contain adult-oriented content and that you are voluntarily choosing to access such content

This checkbox certification is the sole method by which Modern Bond verifies user age. Providing a false certification in connection with age verification constitutes a material breach of these Terms and may result in immediate account termination, forfeiture of any purchased credits or memberships without refund, and referral to relevant authorities where required by law.

MODERN BOND EXPRESSLY DISCLAIMS ALL LIABILITY ARISING FROM, OR IN CONNECTION WITH, ANY ACCESS TO THE SERVICES OBTAINED THROUGH A FALSE AGE CERTIFICATION. If a minor accesses the Services by falsely checking the age certification box, Modern Bond bears no responsibility for such access. Liability for any resulting harm rests solely with the individual who provided the false certification and, where applicable, with the minor's parent or legal guardian.

3. User Accounts

3.1 Registration

To access certain features you must create an account. You agree to provide accurate and complete information and to keep your account information current. You are responsible for all activity that occurs under your account.

3.2 Account Security

You are responsible for safeguarding your password and for any activities that occur under your account. You agree to notify us immediately at support@joinmodernbond.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to maintain the security of your credentials.

3.3 Account Termination

You may close your account at any time by contacting us. We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms or our Community Guidelines
• Is harmful to other users, third parties, or us
• Involves fraudulent activity or misrepresentation
• Involves the access or use of the Services by anyone under 18

4. Platform Content and Nature of Services

4.1 Adult Content Platform

Modern Bond is an adult platform dedicated to intimacy, connection, and personal growth. Our platform is sex-positive and may feature content of a mature, sensual, or sexually suggestive nature. By using the Services, you acknowledge and consent to encountering such content. This platform is not suitable for minors.

4.2 Community Forum

Our community forum allows users to post, share, and discuss topics related to intimacy and personal growth. You agree that all content you submit to the community will be:

• Lawful, accurate, and not misleading
• Respectful of other community members
• Free of spam, solicitation, or unauthorized commercial promotion
• Not violating any third party's intellectual property, privacy, or other rights

4.3 Coaching Services

Modern Bond offers personal coaching services including 1:1 Coaching, Couples Coaching, Group Coaching, and Scenario Coaching. These services are provided for personal growth and educational purposes only. They do not constitute therapy, counseling, or any form of licensed mental health or medical service. If you are experiencing a mental health crisis, please seek a qualified licensed professional.

5. Prohibited Conduct

You agree not to engage in any of the following:

• Using the Services if you are under 18 years of age
• Posting, transmitting, or sharing content involving minors in any sexual or suggestive context
• Harassing, threatening, intimidating, stalking, or abusing other users
• Sharing non-consensual intimate images or any content that violates another person's privacy
• Impersonating any person or entity, or falsely representing your affiliation
• Using the platform for any illegal purpose, including solicitation of illegal sexual services
• Attempting to gain unauthorized access to any part of the Services or any other user's account
• Uploading or distributing viruses, malware, or any other malicious code
• Scraping, crawling, or using automated tools to extract data without our written permission
• Circumventing or attempting to circumvent any access controls or security features
• Using the Services to promote discrimination, hatred, or violence based on protected characteristics
• Engaging in any activity that disrupts or interferes with the Services

Violation of these prohibitions may result in immediate account termination and, where appropriate, referral to law enforcement.

6. User-Generated Content

6.1 Ownership

You retain ownership of content you post to the platform (“User Content”). By submitting User Content, you grant Modern Bond a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such content in connection with operating and promoting the Services.

6.2 Content Responsibility

You are solely responsible for all User Content you submit. We do not endorse or control User Content and make no representations as to its accuracy, quality, or appropriateness. We reserve the right (but have no obligation) to remove User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

6.3 Reporting Violations

If you encounter User Content that you believe violates these Terms, please report it using the reporting tools in the platform or by emailing support@joinmodernbond.com.

7. Marketplace and Payments

7.1 Products and Pricing

Modern Bond offers digital and physical products through our marketplace. All prices are displayed in US dollars unless otherwise stated. We reserve the right to modify pricing at any time; changes will not apply to confirmed orders.

7.2 Payment Processing

Payments are processed by Snipcart, our third-party payment processor. By making a purchase, you agree to Snipcart's terms of service and authorize us to charge your selected payment method for the total amount of your order, including applicable taxes and fees. We do not store full payment card information on our servers.

7.3 Memberships and Subscriptions

We offer membership plans on a recurring subscription basis. By subscribing, you authorize us to charge your payment method at the applicable recurring rate until you cancel. You may cancel your membership at any time through your account settings. Cancellation takes effect at the end of the current billing period; we do not provide prorated refunds for partial periods unless required by applicable law.

7.4 Refund Policy

Digital products are generally non-refundable once accessed or downloaded. Physical products may be returned within 14 days of delivery if unused and in original condition. Coaching session fees are non-refundable after a session has commenced; cancellations made at least 24 hours before a scheduled session may be eligible for rescheduling. 7.5 Taxes

You are responsible for all applicable taxes on your purchases. Where required by law, we will collect and remit sales tax on your behalf.

8. Intellectual Property

8.1 Our Content

All content, branding, trademarks, logos, graphics, and software comprising the Modern Bond platform (excluding User Content) are owned by or licensed to Modern Bond and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our express written permission.

8.2 Feedback

If you provide us with suggestions, feedback, or ideas about the Services (“Feedback”), you grant us a perpetual, irrevocable, royalty-free license to use that Feedback for any purpose without compensation or attribution to you.

9. Third-Party Services and Links

Our Services may integrate with or link to third-party websites, platforms, or services (including Snipcart, Supabase, and social media platforms). These third parties are governed by their own terms and privacy policies. We are not responsible for the content, practices, or availability of any third-party services.

10. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

COACHING SERVICES ARE NOT A SUBSTITUTE FOR PROFESSIONAL MENTAL HEALTH, MEDICAL, OR LEGAL ADVICE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MODERN BOND, ITS OFFICERS, DIRECTORS, EMPLOYEES, COACHES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless Modern Bond and its officers, directors, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any claim that your User Content caused damage to a third party

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.

13.2 Dispute Resolution

Before initiating formal dispute proceedings, you agree to contact us at legal@joinmodernbond.com to attempt informal resolution. Most concerns can be resolved quickly and informally.

13.3 Arbitration

For users located in the United States: any dispute that cannot be resolved informally within 30 days shall be resolved through binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules. CLASS ACTION WAIVER: You agree that all disputes will be arbitrated on an individual basis; you waive your right to participate in a class action lawsuit or class-wide arbitration.

13.4 EU / UK Users

If you are located in the European Union or United Kingdom, you may also have the right to pursue claims before your local courts or use the European Commission's Online Dispute Resolution platform. Nothing in these Terms limits your rights under mandatory local consumer protection law.

13.5 Canadian Users

If you are located in Canada, you may have rights under applicable provincial consumer protection legislation that cannot be overridden by contract. Those statutory rights are preserved.

14. Digital Millennium Copyright Act (DMCA)

We respect intellectual property rights. If you believe content on our platform infringes your copyright, please send a notice to legal@joinmodernbond.com with:

• A description of the copyrighted work you claim has been infringed
• A description of where the infringing material is located on our platform
• Your name, address, telephone number, and email address
• A statement that you have a good-faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate
• Your physical or electronic signature

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Modern Bond regarding the Services.
• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our written consent.
• Force Majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control.
• Notices: Legal notices to us must be sent by email to legal@joinmodernbond.com.
